February 04, 2020: Yorkville Village Board Meeting

The regular monthly meeting of the Yorkville Board of Trustees was called to order at 6PM by Mayor Michael A. Mahoney. Present were Deputy Mayor James G. Collea and Trustees; David J. Morosco, Deborah L. Constas, Adam J. Sassone. Also present were Village Attorney John Dillon and Village Clerk/Treasurer Stephanie Nowak. The meeting was opened with the Pledge od Allegiance lead by Mayor Mahoney. Mayor Mahoney presented plaques of honor to two volunteers from the Yorkville Fire Department. Angelo and Domenick Camerota. Angelo and Domenick, along with two other volunteer firefighters from Whitesboro Fire Department, helped save the lives of three people who were sleeping while their home was on fire. The Mayor thanked them for their service and presented them with a plaque for bravery and heroism. Motion 16-2020 was made to approve the previous month’s minutes. Motion made by Trustee Constas, seconded by Trustee Sassone; all in favor 4-0. Motion 17-2020 made by Trustee Sassone, seconded by Trustee Morosco was to approve the vouchers in the amount of $41,627.77; all in favor 4-0. The Public comment portion of the meeting was opened. A resident of highland Ave. addressed the Board regarding parking violations that she was receiving. A resident of Highland Ave. asked the board if the Village had seen a savings from switching the Streetlights to LED lights. Mayor Mahoney asked Clerk Nowak to explain where the Village was in the process of a credit. Public Comment was closed. Motion 18-2020 was made by Deputy Mayor Collea to approve the results of the Annual Review of Justice Court Records as performed by Clerk/Treasurer Nowak. Trustee Morosco seconded the motion; all in favor 4-0. Motion 19-2020 was made by Deputy Mayor Collea seconded by Trustee Morosco to approve the combination of the Zoning and Planning Boards; All in favor 4-0. Resolution Zoning Board of Appeals Motion by Trustee Collea, seconded by Trustee Morosco to immediately eliminate the Planning Board and the Board of Appeals and create a new Zoning Board of Appeals effective February 4, 2020. Motion carried. Local Law Number 2 of 2020, an Act to abolish the Village’s Existing Planning Board (Chapter 23) and to amend the Code of the Village of Yorkville, New York, Chapter 135, Article VII, subsection 135-34 Zoning and create a new Zoning Board of Appeals which shall have the same powers and duties as a Planning Board and a Zoning Board of Appeals. WHEREAS, the Village of Yorkville has the authority to abolish the existing Village’s Planning Board and Zoning Board of Appeals and create a new Zoning Board of Appeals with the powers and duties of a Planning Board and a Zoning Board of Appeals. WHEREAS, the Village of Yorkville maintains a body of law, The Code of the Village of Yorkville, New York, to administer the Zoning Board of Appeals and Planning Board; BE IT ENACTED by the Board of Trustees of the Village of Yorkville that this Local Law amends the Code of the Village of Yorkville as follows: 1. Chapter 135, Article VII, subsection 135-34 “Zoning”. A. The Board of Trustees of the Village of Yorkville hereby abolishes the existing Planning Board and Zoning Board of Appeals; and B. Hereby creates a new Zoning Board of Appeals and gives and grants to the new Zoning Board of Appeals the powers and duties of a Planning Board and a Zoning Board of Appeals as set forth in the New York State Village Law, and Chapter 135, Article VII, subsection 134-34 of the Village Code; and C. Wherever the terms Zoning Board, Zoning Board of Appeals or Planning Board appear in the Code of the Village of Yorkville, said terms shall hereafter mean and refer to the Zoning Board of Appeals created upon the adoption of this Local Law; and D. The Mayor shall appoint the members of the new Zoning Board of Appeals, subject to approval of the Board of Trustees; and E. There is hereby established a Zoning Board of Appeals consisting of five members including one chairperson, and, in addition, there shall be two alternates, which shall function in the manner prescribed by law. The members of the Zoning Board of Appeals shall be residents of the Village and shall be appointed to serve for five-year terms, as prescribed by law. Vacancies occurring in said Board, by expiration of term or otherwise, shall be filled in the manner provided by law. 2. Village’s Existing Planning Board (Chapter 23) is hereby abolished. 3. The Board shall have and exercise the additional powers and duties prescribed by the Village Law and the Subdivision Regulations of the Village of Yorkville. 4. This Local Law shall become effective on February 4, 2020. 5. To the extent any parts of this Local Law are inconsistent with or conflict with any parts, sections or chapters of the Village Code, the provisions of this Local Law shall control. Motion 20-2020 was made to approve the resolution by Trustee Constas, seconded by Trustee Sassone; all in favor 4-0. Motion carried. Deputy Mayor Collea reported that Thomas Gaines of the DPW has retired after over 20 years of service. The Board thanks Thomas for his service. Deputy Mayor Collea would like to hire Nicholas Morosco to the DPW. Motion 21-2020 was made by Trustee Sassone, seconded by Trustee Constas; all in favor 3-0. Trustee David Morosco abstained from voting due to a conflict of interest. Trustee Morosco wanted to thank the Camerota brothers for their actions during the fire. Trustee Morosco also informed everyone that the Fire Department Installation Banquet will be held on Saturday, February 8th. Trustee Constas had nothing to report at this time. Trustee Sassone wanted to thank Thomas Gaines for his service and congratulate Nicholas Morosco. Trustee Sassone also expressed his appreciation to Domenick and Angelo Camerota. Financial Report was written. Village Attorney John Dillon had nothing to report at this time. Joseph Morosco and Salvatore Granato of the DPW had no news to report. Codes reports were written. Fire Department report by Chief Joseph Morosco- the Fire Department is finalizing the remodel to the upstairs of the Fire House. The new rescue should be in service soon. Planning Board report was written. Zoning Board Report was written. Police Department Report was written. Mayor Mahoney also thanked Thomas Gaines for his service.
